GENERAL TERMS AND CONDITIONS – CAMPTRONICS BV

These terms and conditions apply to all sales of hardware, software licenses, subscriptions, installations, services, and advice provided by Camptronics BV or its authorized partners, established in Belgium.

1. Definitions

  • Camptronics: Camptronics BV, provider of hardware, software, consultancy, and installations.

  • Customer: Any party (consumer or business) purchasing products or services from Camptronics.

  • Hardware: All physical products supplied by Camptronics.

  • Software: Any digital service, application, firmware, or cloud platform provided by Camptronics.

  • Installations: Any assembly, connection, integration, or configuration performed by Camptronics or an authorized partner.

  • Subscription: Any ongoing or periodic service such as monitoring, data usage, or remote access.

  • Advice: Any recommendation, manual, guidance, instruction, or technical information provided by Camptronics.

2. Applicability

These terms apply to all offers, sales, installations, services, subscriptions, and deliveries. By purchasing products or services, the Customer agrees to these terms. Deviations are only valid if confirmed in writing by Camptronics.

3. Hardware

3.1 Use & Restrictions Camptronics hardware may not be opened, disassembled, altered, or modified. If the Customer opens or modifies the hardware:

  • All warranties are immediately voided.

  • Technical support is terminated.

  • Camptronics cannot be held liable for any resulting damage.

3.2 Liability for Third-Party Equipment Camptronics is not responsible for damage to other devices, systems, or installations not supplied by Camptronics, even if Camptronics hardware is capable of controlling these systems. The Customer remains responsible for:

  • Correct connection to external systems.

  • Compatibility of their own equipment.

  • Electrical safety and compliance with installation regulations.

4. Software

4.1 Intellectual Property All software, firmware, applications, cloud platforms, and code remain the exclusive property of Camptronics. The Customer is granted a non-exclusive license for use; no ownership rights are transferred. 

4.2 Prohibited Actions The Customer is prohibited from:

  • Copying, distributing, or sharing Camptronics software.

  • Decompiling, reverse-engineering, or manipulating the code.

  • Modifying or integrating Camptronics software into their own software without prior written consent. 

4.3 Sanctions In case of violation, Camptronics may immediately terminate the software license, cease support, and recover all incurred damages from the Customer.

5. Installations

5.1 Execution Installations are exclusively performed by Camptronics or its authorized and trained partners. 

5.2 Tamper Prohibition Installations performed by Camptronics or an authorized partner may not be disassembled, modified, or expanded without prior written consent. Unauthorized modifications void all warranties, liability, and support.

6. Advice

6.1 Non-Binding Nature All advice and recommendations provided by Camptronics are informative and non-binding. The Customer is solely responsible for the implementation of advice not executed by Camptronics. 

6.2 Independent Installation by Customer If the Customer (or a third party) follows advice and performs installation or assembly themselves, Camptronics is not liable for damage, malfunctions, or additional repair costs.

7. Subscriptions

7.1 Data Allowance Subscriptions include a fixed data package based on fair use. If data usage exceeds the allowance:

  • Additional data costs will be charged 1:1 to the Customer.

  • An administrative fee of 25% on top of the additional cost will be applied. 

7.2 Payment Subscriptions are invoiced in advance. Late payment may lead to the suspension or termination of the service.

8. Warranty

Hardware carries a standard 2-year warranty in accordance with Belgian and European law. The warranty is voided by unauthorized modifications, incorrect installation by the Customer, use outside of specifications, or damage caused by third-party equipment. Software is provided "as is"; Camptronics does not guarantee compatibility with all third-party systems.

9. Limitation of Liability

Camptronics is not liable for indirect damages, including but not limited to:

  • Loss of profit or data.

  • Downtime or operational loss.

  • Damage caused by external installations. Total liability is limited to the amount paid by the Customer for the specific product or service.

10. Privacy & Data Processing

Camptronics processes personal data in accordance with the GDPR. A separate Privacy Policy is available on our website.

11. Governing Law

These terms are governed exclusively by Belgian law. Any disputes shall fall under the jurisdiction of the courts in the district where Camptronics has its registered office.
